01. Future Insight

You are currently reading the Future Insight Privacy Protocol. Future Insight is the developer and operator of the Open Urban Platform (Clearly.Hub) and other SaaS solutions: Clearly.Projects, Clearly.BIM, and Clearly.3D-City. Personal data is shared with us when someone becomes a customer, contacts us, or creates an account in our products such as the Open Urban Platform, registers for an event we organize, or subscribes to a newsletter we send. This includes a name, phone number, or email address. However, the IP address is also recorded when an application is visited. It concerns all data that we can link to an individual.

We consider it important to handle personal data with care. We therefore process and secure personal data with care. In doing so, we comply with privacy legislation.

 

02. Type of personal data

When contacting Future Insight regarding the Open Urban Platform or our other products and services, certain data may be exchanged. This data may include personal data. Below, we list all possible personal data that we process. Additionally, we may process other personal information that you send to us via email and that we record for the purpose of answering questions or handling complaints.

• technical measurement data of the equipment such as IP address, characteristics of the operating system and browser; telephone number;
   

Future Insight does not process special and/or sensitive personal data.

Our website and/or service does not intend to collect data about website visitors under the age of 16, unless they have permission from a parent or guardian. However, we cannot verify whether a visitor is older than 16. We therefore advise parents to be involved in their children's online activities to prevent data from being collected about children without parental consent. If you are convinced that we have collected personal data about a minor without such consent, please contact us at privacy@futureinsight.nl , and we will delete this information.
 

03. Why do we store personal data?

We process the above data for one or more of the following purposes (partly depending on which services or functionalities are used):

• Comply with legal obligations, this may be because it is required by tax authorities, regulators, or other regulations;

• Execution of an agreement for the provision of data or an application; (name, company details, email address, telephone number, technical measurement data of the equipment such as IP address, characteristics of the operating system and browser)

• Answering questions that come to us;(name, company details, email address, phone number)

• Complaint handling;(name, company details, email address, telephone number)

• Sending a newsletter;(name, email address)

• Ensuring the proper functioning of our Open Urban Platform and our other SaaS solutions; (technical measurement data of the equipment such as IP address, characteristics of the operating system and browser)

• Improving and making our Open Urban Platform and our other SaaS solutions discoverable. (technical measurement data of the equipment such as IP address, characteristics of the operating system and browser)
   

Future Insight Group BV does not retain your personal data for longer than is strictly necessary to achieve the purposes for which your data is collected. If you are an active user, we need your data to provide our services. If you are no longer an active user, we apply the following retention periods for the following (categories) of personal data:

• name; 1 year

• company details; 1 year

• email address; 1 year

• technical measurement data of the equipment such as IP address, characteristics of the operating system and browser; 1 month

• phone number; 1 year

04. Sharing personal data with third parties

Future Insight Group BV provides information to third parties exclusively and only if this is necessary for the execution of our agreement with you or to comply with a legal obligation.

The data that Future Insight receives and processes is managed by means of:

4.1 Mailchimp

Updates and newsletters are sent via Mailchimp. If you do not wish to receive these, you can unsubscribe. This unsubscribe link is located at the bottom of every Mailchimp message.

 

4.2 Google

Future Insight's email is hosted by Google. If you contact us via email, those emails are stored on Google's servers.

 

4.3 Transip

The websites www.digitaalecosysteem.nl and www.futureinsight.nl and the backups of these websites are hosted by TransIP. Data that you leave on one of these Future Insight websites is stored on TransIP's servers.

 

4.4 Google Drive

Agreements are stored in Future Insight's secure Google Drive environment.

 

4.5 Wix

The websites www.digitaalecosysteem.nl and www.futureinsight.nl were developed using software from Wix.com . Personal data that you share with us is shared with WIX. For more information, read Wix's privacy policy here .

 

4.6 Zapier

Future Insight uses Zapier to connect the newsletter forms on the websites with Mailchimp. The email address and your name are shared in this process.

4.7 e-Boekhouden

Financial data for the invoicing of our services is stored in e-Boekhouden.

 

4.8 Amazon Web Services (AWS)

Our SaaS solutions, including the Open Urban Platform, are hosted on Amazon Web Services. Personal data that you leave in our SaaS solutions is stored on AWS servers.

4.9 Levi9

The development and maintenance of our SaaS solutions is partially outsourced to Levi9. In doing so, Levi9 employees may have access to personal data, within the framework of the agreements we make with Levi9 regarding security and data protection. The Levi9 employees working on our SaaS solutions are based in Serbia. Because Serbia is located outside the European Union, this transfer is secured by the European Commission's Model Contract Clauses.

 

4.10 Google Analytics

The Future Insight website and our web applications collect data to improve the website. This is done using Google Analytics. This data is anonymous and is therefore not linked to your personal data. This includes information regarding, among other things, the duration of your website visit or the pages you visit. All the parties mentioned above comply with applicable privacy legislation and are required to protect data under the GDPR. The GDPR contains detailed regulations for companies and organizations regarding the collection, storage, and management of personal data. These rules apply to all companies and organizations that process personal data of individuals in the EU, regardless of whether those companies are established in the EU or outside of it.

05. Data security

We take appropriate security measures to limit misuse of and unauthorized access to personal data. To this end, we have an Information Security Policy that complies with the ISO 27001:2022 standard. In this way, we ensure that only necessary persons have access to the data, that access to the data is protected, and that our security measures are regularly checked. No physical copies of your personal data are made. Your data is managed only in the aforementioned systems and software. The personal data managed by Future Insight or by the aforementioned third parties is only accessible via the above-mentioned software and is secured with a password and, where possible, with two-factor authentication. With this two-factor authentication, a code is generated from the software and sent to Future Insight. This code must be used during the login process. The devices that access your data are each also locked with a password and/or fingerprint. The number of devices that have access to your data is limited to only the necessary devices. In addition, your visit to our websites and web applications is secured by an SSL certificate. This means that your connection to Future Insight's websites and products is private.

 

06. Privacy by design

We attach great importance to the protection of your personal data. That is why privacy by design is an essential part of our policy. It means that privacy protection is built into software development from the very beginning, rather than being added afterwards as an extra layer.

  • We use security measures such as multifactor authentication and access control in our software architecture.

• Privacy by default:

  • We implement privacy by default, which means that the most privacy-friendly settings are the default.

 

No automated decision-making or profiling takes place based on personal data.

07. Cookies

Upon your first visit to the Open Urban Platform, you will have the opportunity to set your cookie preferences. You can choose which types of cookies you allow: no cookies, only functional cookies, or all cookies. Future Insight uses only functional and optional analytical cookies. A cookie is a small text file that is stored on your computer, tablet, or smartphone upon your first visit to the Open Urban Platform. The cookies we use are necessary for the technical operation of the Open Urban Platform and ease of use. They ensure that the Open Urban Platform works properly and remember preference settings, for example. They also allow us to optimize our Open Urban Platform. You can opt out of cookies by configuring your internet browser so that it no longer stores cookies. Stored cookies can be removed by clearing your browser history. On our website www.futureinsight.nl, during your first visit, you can choose from: no cookies, marketing and functional cookies, or all cookies.

08. Access, correction, modification or deletion of your own personal data

8.1 Right of access

You have the right to request your data recorded and stored by Future Insight at any time. You can do this by sending an email to privacy@futureinsight.nl . You will then receive an overview of your data.

8.2 Right to rectification

Are your details incorrect? Or have your details changed? You have the right to have this rectified by Future Insight. You can do this by sending an email to privacy@futureinsight.nl . You can also update your details via the dedicated URL at the bottom of every email.

8.3 Right of transfer

Should you require the data stored at Future Insight in the event that you switch to another party or service, you have the right to data portability. In this case, Future Insight is required to transfer all your data to the other party.

8.4 Right to erasure of data

Do you no longer want your data to be stored by Future Insight? Then you have the right to have your data deleted. You can do this by sending an email to privacy@futureinsight.nl

8.5 Right to file a complaint

You have the right to file a complaint with the Dutch Data Protection Authority if you believe that Future Insight is not handling your data correctly. You can do this via this link: https://autoriteitpersoonsgegevens.nl/nl/meldingsformulier-klachten .

8.6 Right to stop data usage (objection)

Do you not want Future Insight to use your data? Then you have the right to stop the use of your personal data. You can exercise these rights by contacting privacy@futureinsight.nl and sending a copy of your ID document with the passport photo, the numbers at the bottom of the passport, the ID document number, and the BSN made illegible. We aim to respond within a week.

  

9. Duties

Future Insight processes personal data based on a legitimate interest, namely a commercial interest. This means that it is justifiable why we process personal data. Examples include relationship management and offering services or products from Future Insight. Your data will never be sold to third parties. The data that is mandatory to provide is the minimum data required to offer the services or products. Your email address, for example, is needed to share product updates via a newsletter. If this mandatory data is not provided, Future Insight cannot offer the relevant service.

 

Future Insight reserves the right to disclose data when required by law or when Future Insight deems it justified to comply with a legal request/process or to protect the rights, property, or safety of Future Insight. In doing so, we always endeavor to respect your right to privacy as much as possible.

10. How we secure personal data

Future Insight Group BV takes the protection of your data seriously and takes appropriate measures to prevent misuse, loss, unauthorized access, unwanted disclosure, and unauthorized modification. If you believe that your data is not properly secured or if there are indications of misuse, please contact our customer service or email privacy@futureinsight.nl . Future Insight Group BV has taken the following measures to secure your personal data:

- Security software, such as a virus scanner and firewall.

- TLS (formerly SSL) We transmit your data via a secure internet connection. You can see this in the address bar with 'https' and the padlock icon in the address bar.

- Advanced data encryption;

- Regular security updates and checks;

- Access to data is restricted to authorized persons.

11. Data breaches

We take the protection of your personal data very seriously and do everything we can to prevent data breaches. Should a data breach nevertheless occur, we will act in accordance with applicable legal obligations and our internal protocol.

 

In the event of a data breach, we will:

1) identify and analyze the data breach as soon as possible;

2) if necessary, report to the competent authority (Dutch Data Protection Authority) within 72 hours of discovery;

3) If the data breach poses a high risk to your rights and freedoms, we will inform you immediately, with a clear explanation of what happened and what steps you can take to protect yourself.

 

Following the incident, we will take measures to limit further damage and prevent similar incidents in the future. We continue to improve our security protocols to protect your data.

12. Evaluation and updating of this Privacy Protocol

We strive to process your personal data in a safe and responsible manner. To ensure this, this Privacy Protocol is regularly evaluated and, where necessary, adapted to new laws and regulations, technological developments, or changes in our services. We recommend that you check this Privacy Protocol regularly to stay informed of any changes. However, should we be unable to resolve the matter together, you also have the right under privacy legislation to lodge a complaint with the privacy supervisory authority, the Dutch Data Protection Authority.
